1. Agreement
These Terms govern your purchase and use of services from Create Your Dream Services, Inc. (“CYD”). By ordering, paying for, accessing or using a CYD service, you agree to these Terms and any applicable written quotation, proposal or service-specific agreement.
2. Services
CYD may provide web hosting, domain registration/management, business email, website design/administration, WordPress-related services and custom digital services. Features, limits, support and pricing are those presented at purchase or in the applicable quotation or agreement.
3. Customer responsibilities
You must provide accurate contact/billing information, safeguard credentials and promptly report suspected unauthorized access. You are responsible for activity under your accounts and for the legality, accuracy and rights to content, data, software, images and materials you provide or publish.
4. Acceptable use
You may not use CYD services for unlawful activity, infringement, malware, phishing, credential theft, spam, fraud, attacks on systems/networks, or activity that materially threatens the security, stability or reputation of CYD, its customers or providers. CYD may restrict or suspend affected services where reasonably necessary to protect systems or others.
5. Billing and recurring services
Prices are in the currency shown at checkout or on the invoice/quotation, plus applicable taxes where required. Recurring services continue for the applicable billing period until cancelled. Failure to pay when due may result in suspension, non-renewal or termination after reasonable notice where practicable.
6. Domains
Domain registrations and renewals depend on availability and the rules of the applicable registrar, registry and governing authority such as CIRA or ICANN. A requested domain is not guaranteed until registration completes. You are responsible for accurate registrant information and timely renewals. Expired domains may become unavailable, enter redemption, incur recovery fees or be registered by another party; recovery cannot be guaranteed.
7. Hosting and email
Hosting and email rely on networks, software, data centres and third-party infrastructure. CYD aims to provide dependable service but does not guarantee uninterrupted or error-free availability. Maintenance, security incidents, upstream failures and events beyond reasonable control may affect service.
8. Backups
Unless expressly stated otherwise in writing, customers are responsible for maintaining independent current backups of important websites, databases, email and other data. Any backup feature provided by CYD is an additional safeguard, not a guarantee that every file, version or message can be restored.
9. Website and custom work
Scope, deliverables, revisions, timing and fees for design/administration/custom work may be established by quotation, invoice, email or separate agreement. Work outside scope may require additional fees. You represent that you have permission to provide all content and materials supplied to CYD. Third-party software/assets remain subject to their own licences.
10. Third-party services
Services may depend on domain registries/registrars, hosting/data-centre providers, software vendors, Plesk, WordPress, Square and tawk.to. Their terms, privacy practices, availability and limitations may apply independently. CYD is not responsible for third-party acts or interruptions beyond CYD’s reasonable control.
11. Security
No online service can guarantee absolute security. Customers must use appropriate passwords, updates and account-security practices and promptly report suspected compromise.
12. Suspension and termination
CYD may suspend or terminate for material non-payment, serious/repeated violations, unlawful activity, security threats or abuse. Where circumstances permit, CYD will attempt to provide notice and an opportunity to remedy the issue.
13. Intellectual property
CYD retains ownership of its pre-existing tools, systems, branding and know-how. Rights in custom deliverables are determined by the applicable proposal/agreement and third-party licences. No CYD trademark rights are transferred.
14. Disclaimer and limitation of liability
To the maximum extent permitted by law, services are provided on an “as available” basis and warranties not expressly stated in writing are disclaimed. CYD is not liable for indirect, incidental, special, punitive or consequential loss, including lost profits, opportunities or data. To the maximum extent permitted by law, CYD’s aggregate liability arising from a particular service will not exceed the amount paid to CYD for that service during the three months preceding the event giving rise to the claim. Nothing excludes liability that cannot legally be excluded or limited.
15. Indemnity
To the extent permitted by law, you agree to indemnify CYD against third-party claims and reasonable costs arising from content you provide, unlawful use of the services or material breach of these Terms.
16. Changes
CYD may update these Terms as services or legal requirements change. Material changes affecting ongoing services will be communicated or posted reasonably in advance where appropriate.
17. Governing law
These Terms are governed by applicable Canadian law and the law of the province or territory in which CYD is legally established, without limiting mandatory consumer rights that apply in your jurisdiction.
